Terms of Service

These Terms of Service ("Terms") govern your access to and use of nordwerk.online (the "Service"), operated by Daniel Forot, Leinsamenweg 98, 50933 Köln, Germany ("nordwerk.online", "we", "us"). By creating an account or using the Service you agree to these Terms.

1. The Service

nordwerk.online provides AI email agents that read incoming email messages from a connected email account, generate replies using a knowledge base you configure, and send those replies on your behalf. Difficult cases are escalated to a human email address you specify.

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter into a binding contract. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

3. Your responsibilities

You are solely responsible for the content of the knowledge base you configure and for any reply the agent generates and sends from your connected accounts. You must only connect email accounts that you own or are authorized to control. You agree not to use the Service to send spam, unlawful, deceptive, harassing, or infringing content, and to comply with all applicable laws including the GDPR, the CAN-SPAM Act, and the Google API Services User Data Policy.

4. Google account integration

When you connect a Gmail account, you grant nordwerk.online permission to access that account only as described in our Privacy Policy. We access, use, store, and share Google user data only to provide and improve the agent features described. You may revoke this access at any time inside the Service or via myaccount.google.com/permissions.

5. AI-generated content

Replies are generated by AI models based on the knowledge base you provide. AI output may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing and, where appropriate, monitoring the agent's behavior. nordwerk.online does not guarantee that any reply is factually correct, legally binding, or suitable for a particular purpose. Difficult or ambiguous messages are escalated to your designated human address; you are responsible for handling those.

6. Fees

Some features may require a paid subscription. Fees, billing terms, and any free trial conditions are shown on our pricing page at the time you subscribe. All fees are non-refundable except where required by law. We may change fees on 30 days' notice.

7. Acceptable use

You may not (a) reverse-engineer, decompile, or attempt to extract the source code of the Service; (b) use the Service to build a competing product; (c) probe, scan, or test the vulnerability of the Service without written permission; (d) upload malware, exploit code, or unlawful content; (e) use the Service in violation of any third-party terms including Google's or your email provider's terms.

8. Suspension and termination

We may suspend or terminate your account if you materially breach these Terms, if required by law, or if your use poses a security risk to the Service or other users. You may terminate your account at any time by contacting privacy@nordwerk.online or via the in-app deletion flow. Termination results in deletion of your data as described in the Privacy Policy.

9. Intellectual property

The Service, including its software, design, and text, is owned by nordwerk.online and protected by law. You retain all rights to the knowledge base and content you provide. You grant us a limited, worldwide license to host, process, and use that content solely for the purpose of operating the Service for you.

10. Disclaimer of warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI-generated content will meet your requirements.

11. Limitation of liability

To the maximum extent permitted by law, nordwerk.online's aggregate liability for any claim arising out of or relating to the Service will not exceed the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim, or, if you paid nothing, one hundred euros (EUR 100). nordwerk.online is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

12. Indemnification

You agree to indemnify and hold nordwerk.online harmless from any claim, damage, or expense arising out of (a) your use of the Service, (b) the content you configure or the replies your agent sends, or (c) your breach of these Terms or of any third-party right.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules. Exclusive venue for disputes is the competent court in Köln, Germany, to the extent permitted by law. Consumers retain the mandatory protections of the law of their country of residence.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced inside the Service and by updating the "last updated" date above. Continued use of the Service after changes take effect constitutes acceptance.
